The present study focuses on offering an analysis about the legal practical value that for modern contractual private law has the distinction between the mandate and representation.
Although it is a classic theme, at present, in many cases the confusion between the notion of mandate and the concept of representation persists, giving them an indistinct treatment, a difficulty that probably has its cause, in the absence of a current regulation that highlights the particularities of both legal institutions.
