Abstract

Civil Liability is a subject that has been of great interest, because live in society exposes us to be part of activities and eventualities that involves personal relationship and eventually triggered in the reproach of behavior and indeed demand reparation for damage that is unfairly caused by another. 

In fact, while the social environment evolves there is a growing mass of tort that cannot weaken the principle of the integral reparation of the victim, a thought that does not allow to ignore any unjust damage that is caused, even as a harmful effect of a previous situation that destroys a certain opportunity with reasonably possible expectation, topic that rests on the notion of “Loss of Opportunity” as problematic tort located in a gray area that registers its own modalities, damage caused by total sacrifice or the considerable disappearance of the possibility of making a profit as an advantageous situation or avoiding the production of an unfavorable circumstance.

 

In this regard, the loss of opportunity deserves a prior analysis of the certainty of the damage and its effects over time, the types of expectations that an opportunity may contemplate in order to conclude with the glimpses of this figure in Panamanian Civil Law.
