Abstract

This research examines the legal impact of advances in artificial intelligence (AI) and, in this particular case, studies the introduction of autonomous vehicles, as they challenge traditional civil law regulatory frameworks. While these technologies promise to optimize mobility and reduce traffic accidents, the absence of a human driver raises serious questions regarding civil liability for damage caused to third parties. In this regard, our research presents a historical review of the development of artificial intelligence and its debate on the attribution of civil liability. It also analyzes the different actors involved, mainly users, manufacturers, and programmers, as well as the complexity of determining the degree of participation in the generation of damage. Finally, it argues for the need of an updated legal framework that considers vehicles that do not require a driver, as well as the incorporation of specific criteria for the attribution of civil liability, capable of responding to the challenges posed by autonomous systems and facilitating the safe and regulated integration of these technological innovations into the legal system.
