The oral trial in the words of Professor Alberto Binder constitutes the center of the criminal process. In it, the philosophy and strategy outlined in the theory of the case that begins to string together from the act of imputation is poured. Despite the fact that the methodological design of the system aspires to bring the fewest number of cases possible to trial, this does not ignore the paramount importance that it has as a specification and exposure of the result of the imputation and accusation, as previous and preparatory phases of the oral trial. Its accusatory and adversarial nature finds shelter in the oral trial, which is supported by the principle of adversary, in the elements that it involves in its dialectic, opening statement, direct questioning, cross-examination and closing statement. The oral trial in practical terms becomes the final result of the investigative effort, with a high dose of knowledge of the legally relevant facts, management in the presentation of the evidence and litigation techniques and skills.
