Abstract

Panama being a social, democratic, constitutional and conventional state of law in which, although it is true that, according to the aforementioned, Panama in order to strengthen this rule of law has been committed to the adoption of a new form proposed as a new system based on procedures for the prosecution of criminal cases, which is why it has been adopted by Law 63 of August 28, 2008, the code of criminal procedures in which it immersed in the Accusatory Criminal System with all its perspective stages, in which the same system is the guarantees of the parties from the beginning of the first act of until the completion of the process, therefore when it is a custodial sentence, the person to spent the time that passes the sentence in a public establishment called the penitentiary system, it is here in the guiding principles that contemplates the fundamental basis of the confinement or payment of a person sentenced to a deprivation of liberty from the perspective of the Accusatory Penal System and the principles contemplated by the regulation of the execution of the custodial sentence in the prison system in Panama.
