This article explores the historical origin of terminological confusion between bond and guarantee, emphasizing their fundamental differences. It examines the ways to establish guarantees according to the Public Procurement Law, delving into the concept of a bond, its characteristics, and the applicability of the benefit of excussion. Furthermore, it addresses the types of public procurement bonds classified based on the object of the guaranteed obligation, namely, bid bonds, performance bonds, and advance payment bonds.
