Abstract

Our inheritance law comes directly from the Spanish civil code, as regards testamentary succession. But on the issue of intestate succession, the Honduran Civil Code is adopted, which in turn was inspired by Andrés Bello's Civil Code. The spouse in inheritance law has a difficult situation, especially regarding family home ownership. In Praetorian law, the surviving spouse was granted a usufruct of the real property of the deceased consort. In our law, alimony is contemplated in the intestate succession and inherited as the son of the deceased in all interstate lines of inheritance.
