Abstract

The pandemic of recent years has come to test our ability to adapt in the face of unforeseeable circumstances, from which legal relationships established in a completely different scenario than the one we face today do not escape. Thus, the effects of this crisis have generated a storm of questions in relation to compliance with the agreed obligations in the face of a latent change that has led to the paralysis of economic activities and the transformation of many others.

There are several figures defended and at the same time questioned by different sectors that seek to respond to the conflicts aired in the courts from the legal certainty that some legal systems grant, or in the framework of real uncertainty due to the gaps inherent in a Law of obligations and contracts lacking tools that are expressly an remedy in the face of absolutely unpredictable changes.
