Abstract

In the development of a criminal process, principles must be applied to guarantee respect for the fundamental rights of the parties and among these, the principle of procedural equality of the parties stands out, which allows a balanced treatment and that the same opportunities are offered to that each one better defend their interests. In this study, the exegetical method was used because various national legal regulations, international treaties, doctrine and jurisprudence were analyzed. Therefore, relevant issues such as the notion of the principle of procedural equality of the parties, the concept of criminal mediation, legal regulation and the role of the intervening parties were highlighted. It was determined that the principle of equality in criminal mediation allows mutual benefits for the parties as well as that the most complex cases should only reach the oral trial phase and the culture of peace is consolidated.
