Abstract

This paper developed the classification of the trademark in accordance with the diffusion level on the Panamanian regulations.   First, a study of the national and international theory related with the types of trademarks according with the diffusion was carried out.  Bibliography techniques of revision and regulations inquiry were used for this purpose.  Following that, the law regarding Panamanian industrial property was interpreted, based in the exegetic method with the purpose of verifying the existence and scope of these types of trademarks in the Panamanian legal system.

Within the conclusions of this paper, the existence of three main types of trademarks is noted according to their diffusion: the common trademark, the prominent trademark and the renowned trademark.  The special legal protection offered by the Panamanian law to prominent trademark and renowned trademark is also noted.
