Abstract

The goal of this research was to know the criteria that were used to apply mitigating circumstances of criminal responsibility on the part of the Criminal Chamber of the Supreme Court of Justice of Panama. To achieve this, bibliographic review and jurisprudence analysis techniques were used. It was based on an explanation of the mitigating concept according to theory, as well as its normative use in this country. It was concluded that, in some cases, the Criminal Chamber was very rigorous when analyzing the concepts of mitigating circumstances, which meant an interpretation against the inmate Rights, and therefore, a denial of Rights.
