Abstract

This article analyze the new the new criminal shape of elder abuse (art…..) which were added to Penal Code in the year 2020 through Law No. 149 of April 24, its objective is to recognize the elements that make it up, compare them with others very similar as the personal injury and domestic violence, and stay how it is established in other countries. In addition, it is expanded with the protection of older adults, social conflicts and alternative means of conflict resolution that can be used to avoid these types of events. The analysis was done through the inductive method, starting advantages of using the new crime, although it presents excessive casuist, which forces us to consider the principle of specialty to be applied.
